What a Foreign Owner Needs to Legally Rent Short-Term in Málaga

The four things to resolve before you accept your first guest.

If you’re a foreign owner who wants to rent your home short-term in Málaga, there are four things to resolve before your first guest: your NIE; whether your property can be registered as a tourist property (VUT); what your community of owners allows; and what taxes you’ll pay given your residency situation. 1. The NIE — the first step

The Número de Identidad de Extranjero (NIE) is your tax ID in Spain. You need it to buy the property and for any tax formalities afterwards. One nuance many people miss: having an NIE is not the same as having residency — they’re completely different procedures, and confusing them causes headaches later.

2. Managing from abroad is harder than it looks

If you live outside Spain, someone has to answer guests, coordinate repairs, receive contractors, keep tax paperwork current, manage contracts, collect payments — and fix a burst pipe at 2 a.m. A Málaga property can be an excellent investment and, at the same time, a source of constant stress if you manage it yourself from abroad. 3. Your tax obligations depend on your situation

What you pay on rental income isn’t a fixed number. It depends on whether you’re a tax resident in Spain, whether you’re an EU/EEA resident, the type of rental, which expenses you can deduct, and whether a tax treaty exists between Spain and your country. A generic online calculator won’t give you the real figure — for that you need a tax adviser who knows your case.

4. Registration is not optional

Before operating, confirm: the type of rental you’re doing; whether your property needs the national registration number (Royal Decree 1312/2024); whether the regional VUT registration applies; and whether your community of owners permits it.
